class action lawsuit against finance america? Just received a "Legal notice by order of the court" about a class action lawsuit against finance america for it's alleged practice of obtaining names and addresses. This seems to have happened between 2003 thru 2006. Can't find info on the net about this, anyone else receive this notice or know something about this?
Can I call for a lawsuit against greedy We Finance? I bought a used car at so called 'We Finance' in the beginning of this year, and I never missed or been late for a payment. I have retained all the record of payment including delivery record. It's almost paid off by now, and they are really pissing me off by trying to charge me "LATE FEE". They didn't check my credit or didn't do anything like that because they were like street merchants. I'm really sure that they are going to try withdrawing a lot more money than I am supposed to pay at the last month. So, I want to show them I am not such a sucker and call for a lawsuit against them if they try to commit some illegal conspiration. Any advise to scare them real good?
What are my chances of winning a lawsuit against a predatory lender? We got into a home loan where we were lied to about a lot of stuff. They never told us it was negative-amoritization loan, and the first set of documents say nothing about that, only the closing papers briefly state something about it. Also, they really over-stated our income, they gave us a split loan, which has a balloon payment and a 14.125% intrest rate on the second loan. They told us that this was the only way they could finance us. We were lied to about a lot of things, particularly the negative amoritization. In the loan explanation it says P&I payment $930 for our first loan. It says nothing about how that is actually less than the minimum intrest amount and that our loan will increase. We signed the papers before we were aware of the negative amoritization, because the notary told us that everything we needed to know was in the first documents given to us. Anyway, if I try to take this to court, what can be done for me, and do I have a good chance of winning the case?
Need attorney to file a lawsuit against car dealership? I bought a car in different state, but those assholes faked my signature and charged me about 10,000$ above what i was suppost to pay, I financed the car, they sent those papers with fake signatures to bank and I am still paying for it, I filed a BBB complain but dealership want respond to them, so they just left negetive feedback on their rating, and I cant even file a civil court, since I am in different state, so I just need an attorney that can help me with this, perhaps file a lawsuit for about couple millions, so they will learn their lesson, since I am not the first person that they screwed over like this. I alos have plenty of evidence. Any info will help, BTW the dealership is Baron Auto Mall in Queens/Hollis, New York
Do we want a candidate who will hire others to commit fraud in fundraising? By "candidate" I mean Hillary. http://www.hillaryproject.com/index.php?/en/story-details/media_continue_to_ignore_campaign_finance_fraud_lawsuit_against_hillary_cli You are bringing up Bush in your "answer". This indicates to me that you want another Bush in office. Someone who will lie and cheat for power.
Do you need a Ph.D. in finance to spot a dumb idea? I'm wondering what caused this sub-prime debacle? Was it some bad management construct or what? I remember a local car shop was paying their mechanics per repair rather than per hour - the same mechanics who diagnosed the problem. What do you think happened? They sold unneeded repairs, eventually suffered a huge class action lawsuit. Did something similar happen with this sub-prime nonsense? It seems so obvious that after the rate jumps these people are not going to be able to afford to continue paying the mortgage. Were the salesmen being paid per-sale with no other conditions? Or was competition too fierce, or house prices too high? 50 year mortgages kind of makes sense - house prices are too high but at least you're paying a steady rate - just accept the fact that its more like 'renting' since you'll almost never take a bite out of the principal. A changing rate sounds a lot like 'bait and switch'. Yeah people should be savvy enough to see it coming..but many are not.
How will Obama help the foreclosure crisis when his finance campaign mgr,Penny Pritzker owned a subprime bank? Obama during speeches and debates pledged to help with the foreclosure crisis and crack down on subprime lenders. However, his own finance campaign chair owned Superior Bank. Superior Bank was one of the original lending institutions to use their investors to buy sub-prime mortgages. After investigation the bank was shut down in 2002 by the OTS and FDIC. The investigation showed It engaged in deceptive and faulty lending, questionable accounting practices, and charged hidden fees. A disproportionate number of them were minority. Wanting to avoid a lawsuit, the secretive Pritzkers quickly agreed to what the FDIC hailed in December as the biggest settlement they had ever negotiated. The Pritzkers would pay $100 million immediately, then $360 million over 15 years. As of September 2002, according to FDIC figures, the insurance fund was still out $440 million after this settlement. Why would Obama place Penny Pritzker as his campaign finance mgr ? Mona Lisa- I never indicated that home owners are not responsible for their actions. I agree that they made the decision on variable rate mtg's and knew the rate could increase BUT that is not my question-This bank was under investigation and proven to have hidden fees, predatory lending, and deceptive lending. There is a HUGE difference between a legitimate mortgage company disclosing information legally and ethically and borrower's ignoring the risks and companies that are shut down for proven deceptive practices as investigated and shut down by the FDIC. Vera W- Congratulations your response is probably the most IGNORANT rant I have ever received. In response to your illiterate statements: 1) " well qualified" because she owned a bank DUH- obviously you did not comprehend or thoroughly read the details in my question, She owned a bank that was SEIZED, CLOSED, for DECEPTIVE PRACTICES. This is not the type of person that is "well qualified" to be in charge of his finance campaign. It is poor judgement. 2)You asked if I was qualified-that was an unjustified insult- I am an honest person, and have not engaged in deceptive practices such as Pritzker, nor lead racist speeches such as Wright, or in court such as his associate Rezko. So, by Obama's standards no I would not qualify. 3) As far as who investigated, look above again to the details in the question and you will see the FDIC and OTS. 4) As far Obama being in school in 2002-No, he was an Illinois Senator 1997-2004. Wake up! Hope I educated YOU! Lazy Vera here are the links- now you have to click on these to be able to read them or considering your reading skills you might want someone to read them to you: http://loanworkout.org/2008/03/02/is-obama-for-the-people-or-the-banks/ http://www.fdic.gov/bank/individual/failed/superior.html http://www.peopleforchange.net/index.php?showtopic=33867 http://www.thenation.com/bletters/20080211/fraser/edpicks http://www.bostonnow.com/blogs/oldmole/2008/02/12/obama-campaign-finance-chair-involved-in-superior-bank-sampl-scandal http://www.commondreams.org/archive/2008/02/28/7340/ Vera- No you didn't "get me" and don't worry I won't hurt myself psycho. Glad, I could educate you but it appears you are still under the influence of the "kool aid". Vera- if you answer a question BASHING the person asking the question be prepared for a response. I am tired of conversing with you. It is a lost cause you will never see the light. Move on.
Can you actually purchase rental property by financing the downpayment? If you file a LLC, and want to purchase a multi-family housing property for a cashflow investment under that LLC entity. I know you will probably have to still sign a personal garuntee that if the business goes under you will be liable for the paying back the loan. In this case I guess I have two questions. First, If you went through with this deal and later on down the road a lawsuit from a tenant is filed against you. Could they peirce the corprate veil since you signed a personal garuntee for that property even though its filed under the LLC. Could they use the garauntee as proof that you did not keep the LLC and yourself as seperate entities. Second, if the property was for exaple: $200,000. And you needed to put 10% down. And had now cash. Could you finance only for the $20,000 and use the possitive cashflow to garauntee the other 90% of the loan? Cause if the properties worth is based on the cashflow it creates, the lenders use the property itself againt the loan, correct?
Can a collections agency sue me? Here is the deal. I owe 44,000 for a auto finance. the collection agency gave me a settlement of 28,000. They said if I don't make a payment by tommarow it will go into a lawsuit. Can they actually sue me? and what is the wort damage that can happen?
Finance/credit/ collections question please read below, rather specific can I ??? In 2000 I got really sick & almost died & wracked up some big dr bills. I went to declare bankruptcy in 2001 & my attorney said we'd settle so we did. I gave him all my bills. A few dr's never contacted me so I didn't have their bills to give him. They didn't contact me for like 5-6 years until recently I was working on my credit report & I'm sure they saw that. Now they say I owe them all that interest & I have asked the collections agency only for copies of when they have contacted me as I feel it is unfair to charge me for something I didn't know about. I was too sick to search out all the 1000's of bills but I did honestly turn in all to the tune of $38000 & my family paid them off. But why don't they have to send me copies of when they contacted me ? They said now they are preparing a lawsuit & the interest is $100 and the bill is $360 principal, I have figured out it will cost me more to pay my attorney to check it out than to pay the interest, but I am still very poor ???

I am 23 years old and I was given $25K, what is the best way to invest this money? Hello Everyone! Long story short: I am a 23 year old young lady that was given $25K from a lawsuit. I graduated from college less than 2 years ago with a degree in Finance, so I'm not LOST when it comes to investing, etc... but I would LOVE some opinions. My current standing: **My 2001 car is paid off and in good shape. I have 2 credit cards, all with high spending limits but very low balances. I had a loan, but just paid that off. My credit score is over 720 currently, but want it to be over 770 by the end of the year (not sure if thats relevant; but its a MAJOR goal of mine). What I plan to do: **I already used about 4K to pay off all of my loans, and pay 6 months worth of car insurance (which is very expensive; I live in NY) **Invest 5K in a Roth IRA -- on EFTs **Put 5K in a savings account (I'm looking @ one with a 5% return) --- This leaves me with 10K... any suggestions? Any changes to what I'm thinking of so far?? THANKS IN ADVANCE!!
Auto loan lawsuit, court summons arrived today. What now? My mother (67) let my younger brother borrow her credit to finance a car. Well everything went well, until he was gunned down and murdered in Los Angeles. My mother fell into deep depression to the point were she's still taking medication. Well sure enough the vehicle was repo'd and now she gets a court summons at her door, stating that she is being sued. My mom doesn't work, hasn't worked for a while because of her age. As a matter of fact she's currently living under a section 8 housing develpment and recieves SSI as her only source of income. I don't intend to justify the delinquent account and much less cause pitty, however my questions are: What will most likey happen? Will she get her SSI money taken? Will she go to Jail? I would honestly appreciate any insight and opinions. Thank you so much in advance.
Is there a law against false appraisals? When we bought our house 2 years ago,we were given an appraisal of $145,000.00,since buying, we've added a new roof and finished an unfinished room(making an extra bedroom),while trying to refinance we find that the appraiser whom did the first appraisal was a friend of the bank pres. as well as a friend of the house owner & "fudged" the numbers to help his friend sell his house,we recently had it appraised & it appraised @133,500.00, part.due to this we were unable to get financing. Is this a cause for a lawsuit?
Lawsuit against a bankruptcy trustee??? We believe we have a case against a trustee for, among other things, breach of feduciary responsibility. He was the appointed trustee in a chapter 11 case, and mis-represented the position of the company to push for liquidation. He told the banks that were financing the company that he had buyers, and would be able to expedite the sale if the banks would step aside and allow him to force a chapter 7 wherein he would have complete control. It's been 20 months, nothing's been sold, no creditors have been paid, the collateral was released to the banks but they have been unable to sell it. The principals are out 3 plus million dollars and a company which had a 25 year history was completely destroyed. Now, the trustee is lying low. A new judge has been appointed, and it appears that they are just trying to make the whole thing go away. Read more about the debacle on PACER/Hampshire Distributors, Inc.

What can be expected from Six Flags stock after that accident? I have some stock and Yahoo projects an 8 dollar price in a year. But I am sure an impending lawsuit is coming from what happened to that poor girl. Is that going to cause a fall in its price or will insurance offset what the park will have to pay out. Basically is this the time to sell or should I hold for a while? http://finance.yahoo.com/q?s=SIX
Any one know that the John Doe bill has been passed? After nearly a week of intense, behind-the-scenes wrangling, congressional negotiators late Tuesday agreed to include in the pending Sept. 11 security bill sweeping liability protections for citizens who report suspicious activity they fear might be linked to terrorism. Thanks to courageous, principled and tenacious efforts by key legislators like Rep. King and Sens. Lieberman and Collins, the American people are going to be free to do their part in the War for the Free World – serving as indispensable eyes and ears for those trying to protect us against terrorism – without fear that the likes of CAIR will be suing them for doing so.” language will provide protection against the sorts of harassment lawsuits filed by the Council on American-Islamic Relations (CAIR) after several unidentified individuals reported six Muslim imams engaged in suspicious – and frightening – behavior prior to boarding a USAir flight in November 2006. CAIR has been identified as a front organization for organization for the Muslim Brotherhood and is an un-indicted co-conspirator in an alleged terrorism-financing plot.

Study: Blacks pay higher auto loan rates As if we didnt know this already? WASHINGTON - Blacks have been charged higher auto loan rates than other auto buyers, federal research says. But the gap in loan rates could narrow, and possibly disappear, as the result of recently concluded lawsuits. ADVERTISEMENT Blacks paid a typical auto loan rate of 7 percent for new cars, compared with a rate of 5 percent for whites in 2004, according to a consumer organization's analysis of the Federal Reserve Survey of Consumer Finances. That was the most recent survey available. And blacks were more likely than auto buyers in general to have auto loan rates higher than 15 percent. For used car loans, 27 percent of blacks who buy cars were charged interest rates of 15 percent or more. Blacks were three times as likely as whites — 27 percent to 9 percent — to have auto loan rates at least that high, according to the report released Monday. Hispanics were paying a typical rate of 5.5 percent for new car loans, while 19 percent of Hispanics had loans for used cars over 15 percent, the analysis found. Lenders' suggested quote rates are based largely on the buyer's credit history, but auto dealers often raise the rate higher than that risk-related rate without discussing the rate with the customer, consumer advocates said. And they question the causes of those rate differences. "It's hard to believe that any differences in creditworthiness explain all of these rate gaps," said Stephen Brobeck, executive director of the Consumer Federation of America. "They size you up, the car salesmen and finance and interest guys. They must think African-Americans are more vulnerable to a markup." But a series of legal actions against auto finance firms seeking fair treatment for minorities could help solve that problem. "We had 11 lawsuits, the last of the cases settled last month," said Stuart Rossman of the National Consumer Law Center. "We reached a settlement with each of the finance firms. Our cases involved discrimination. We believe the terms of the settlements will eliminate discrimination." The first of the lawsuits was filed in 1998 in Nashville, Tenn., against General Motors Acceptance Corporation and was settled in 2004. The last settlement became final in April. The effects of those legal actions may not be known for some time, however. The National Auto Dealers Association questioned what accounts for the rate differences, but encouraged auto buyers to do their homework before going to buy a car. "The question that still is unanswered is why," said David Hyatt, a spokesman for the dealer's association. "People should do their homework and shop around. It speeds up the transaction, makes for a smoother transaction and is more likely to result in a satisfied buyer." Hyatt said an organization supported by the auto dealers, Americans Well Informed on Automobile Retailing Economics (AWARE), offers tips to potential car buyers. Chris Stinebert, president and chief executive of the American Financial Services Association, said his group is interested in educating consumers. "AFSA and its members believe there is no place for discrimination in the vehicle financing system," he said. The lawsuit settlements against auto finance companies call for caps on dealer markups, opportunities for blacks and Hispanics to get loans with no markups within the next few years, more information about interest rate terms and consumer education for minorities. "The lower markup caps have leveled the playing field," Rossman said. Consumer advocates say prospective auto buyers should call their bank or credit union for a rate quote to expect on an auto loan. That could protect them from unfair markups. Other ways to hold down costs. _Make all loan payments on time. _Buy a used car, or a less expensive new car. _Take out a loan over a shorter time. The survey of 4,519, including 605 blacks, was analyzed by Catherine Montalto, a consumer specialist at Ohio State University for the Consumer Federation of America. The survey was conducted between May and December of 2004.
Do you think Fred Thompson would make a good running mate for John Edwards? I know that Thompson is a registered Republican and Edwards a Democrat, but both are former Tort attorneys who made a bank off of representing clients for personal injury lawsuits. If you think about it, Thompson, is nothing more than a RINO. While in the Senate, he voted against legislation which would tighten up the ability to file frivolous lawsuits and against legislation which would limit attorney fees. In addition, he used to be a lobbyist for the Teamsters Union and supported the McCain-Feingold Campaign Finance bill. John and Fred for President? What do you think? =For Vincefoster: http://www.politico.com/news/stories/0607/4470.html Enjoy. I sure did.

I have a civil judgment on my credit report.? Household Finance closed my account and filed a lawsuit. Within two weeks of receiving notice of the suit, the debt was paid in full. I never answered the complaint and we never appeared in court. The attorney sent me a Satisfaction of Judgment. Should it have been a Stipulation of Settlement since there was no court intervention? Is it correct that it should appear as a CIVIL JUDGMENT on my credit report? The report also does not reflect that it was paid. I know I can't get this removed from my credit report but I'd like it to reflect the facts.
Contractor being sued by Owner/Builder just 3 days before the 10 year statue of limitations. Any Hope? Owner/builder pulls building permit and signs permit as Owner/builder, then hires contractor for $ 250K project. Project started 01-06-1996, completed around 11/30/96. Owner/Builder screened all sub contractors before hiring. Owner then instructs contractor who to hire. Some sub-contractor payments are paid by the contractor and some are paid by the owner. On January 03 2006 the Owner/builder files suit against the contractor for defects, the amount is more than double the amount he received. A lawyer has been hired. Lawyer has spent thousands of dollars (from the contractor), now asking for more, with no hope in site. Trial date set for January 2007. Note: Owner has won mutiple lawsuits with insurance companies, general liability for contractors and homeowners for work completed on her permanent residence. We are at a loss, is there any hope for the small business owner against the property owner who uses insurance claims to finance their next project.
A year ago i purchased a mobile home in a park.? The place burned down this past september, and the insurance company won't pay me the remaining balance owed to me because i don't have the title to the place. i did some homework and discovered that the park actually financed to me a mobile home with someone else's name on the title! the park says that they will file for a title but that was back over 8 weeks ago. do i have grounds for a lawsuit? i have heard that a mobile home was similar to a car; when you get it, the title comes shortly. i never saw the title to mine. all i have as proof of ownership is the contract. is this illegal? should i hire an attorney?
Should the federal government take the responsibility away from local government for spending money unwisely? Should the federal government take the responsibility away from local government for spending money unwisely? It took a collapsing bridge in Minnesota to alert people across the country to the fact that many other bridges in many other places have been allowed to deteriorate without adequate maintenance. If this were just a matter of poor political leadership at various levels of government, we could at least hope for better leaders in the future. But the problem goes deeper than that. It is not just the people but the incentives that are responsible for the neglect of infrastructure, while tax money is lavished on all sorts of less urgent projects. In other words, when there is a complete turnover in political leaders over time, the same problem will remain because the same incentives will remain when new leaders take over. Some people claim that the problem is how much money it would take to properly maintain bridges, highways, dams, and other infrastructure. But money is found for other things, including things far less urgent and some things that are even counterproductive. The real problem is that the political incentives are to spend the taxpayers’ money on things that will enhance politicians’ chances of getting reelected. There may be enough money available to maintain bridges and other infrastructure but that same money can have a bigger political payoff if spent building something new instead of maintaining and repairing existing structures. When money is spent building a new community center, a golf course, or anything that will be newsworthy, there will be ribbon-cutting ceremonies and the politicians who cut the ribbons can expect to see their pictures in the newspapers and on TV. All that keeps their name before the public in a positive role and therefore enhances their prospects of being reelected. But there are no ribbon-cutting ceremonies when bridges are being repaired or pot-holes are being filled in. These latter activities may be more valuable than a community center or a golf course, but they are not nearly as photogenic. The preference for showy projects that will enhance a politician’s career prospects is not peculiar to current politicians. Adam Smith pointed out the same thing about politicians in 18th-century Europe. We can vote the rascals out but the new rascals who replace them will face the same incentives and in all likelihood will respond in the same way. A pattern that has persisted for more than two centuries is likely to continue unless something fundamental is changed. What really needs to be done is to change the incentives. While most bridges in the United States are owned and operated by government agencies, there are times and places where bridges have been owned and operated by private companies, just as numerous other goods and services are provided through the marketplace. How would that change the incentives? A company that has to get the money to build and maintain bridges or other infrastructure through the voluntary actions of people in the financial markets, instead of being able to extract money from the taxpayers, is going to find financiers a lot more finicky about what is being done with their money. People who are putting their own money on the line are going to want to have their own experts taking a look under the bridges they finance, to see where there are rust, cracks, or crumbling supports. When people know that the lawsuits that are sure to follow after a bridge collapses are going to drain millions of dollars of their own money — not the taxpayers’ money — that keeps the mind focused. Those who like to think of the government as the public interest personified may be horrified at the idea of turning a governmental function over to private enterprise. Politicians who want to hang onto sources of patronage and power will of course encourage people to look at things that way. But the track record of privately run infrastructure will compare favorably with government-run infrastructure. But that is only if we stop to compare — and to think.
Third Party Disclosure Violation? I am currently just over 30 days past due on my car payment. Yesterday, a representative from my auto finance company called my mother (whom I listed as a reference on my finance application), told her that I am behind on my car payment and that I was going to lose my car if I did not contact their office immediately. Isn't this third party disclosure in the attempt to collect upon a debt and grounds for a lawsuit? If so, what state would I have to pursue this lawsuit in? I live in Arizona, my finance company is based in Utah and my mother lives in Georgia.

Handled himself with enormous courage, dignity, grace, determination, and leadership in the aftermath of the September 11, 2001 hijackings and anthrax attacks. He almost single-handedly held this country together during those searing days: Just three days after the attacks, in his address at the National Cathedral, the President reassured the nation when he said: "War has been waged against us by stealth and deceit and murder. This nation is peaceful, but fierce when stirred to anger. This conflict was begun on the timing and terms of others. It will end in a way, and at an hour, of our choosing." On Friday, September 14, 2001, President Bush visited Ground Zero. Standing on a crushed and burned fire engine atop the smoldering pile at Ground Zero, he put his arm around a retired firefighter who had volunteered to help, and began speaking to the crowd. Rescue workers shouted that they could not hear him. Someone handed him a small American flag and bullhorn. The President spontaneously shouted: "I can hear you. The rest of the world hears you. And the people who knocked these buildings down will hear all of us soon." The crowd roared with cheers and chants of "USA! USA! USA!" Then he raised that American flag and rallied a nation. Killed U.S. involvement in the International Criminal Court. 3. Told the United Nations we weren't interested in their plans for gun control (i.e., the International Ban on Small Arms Trafficking Treaty).* 4. The only President since the founding of the UN to essentially tell that organization it is irrelevant. He said: "The conduct of the Iraqi regime is a threat to the authority of the United Nations, and a threat to peace. Iraq has answered a decade of UN demands with a decade of defiance. All the world now faces a test, and the United Nations a difficult and defining moment. Are Security Council resolutions to be honored and enforced, or cast aside without consequence? Will the United Nations serve the purpose of its founding, or will it be irrelevant?" We all know the outcome and the answer. 5. Told the Congress and the world, "America will never seek a permission slip to defend the security of our country." Government Reform 1. Improved government efficiency by putting hundreds of thousands of jobs put up for bid. This weakens public-sector unions and cuts undeserved pay raises. 2. Initiated review of all federal agencies with the goal of eliminating federal jobs (completed September 2003) in an effort to reduce the size of the federal government while increasing private sector jobs. 3. Led the most extensive reorganization the Federal bureaucracy in over 50 years: After 9/11, condensed 20+ overlapping agencies and their intelligence sectors into one agency, the Department of Homeland Security.* 4. Ordered each agency to draft a five-year plan to restructure itself, with fewer managers. 5. Converted federal service contracts to performance-based contracts wherever possible so that the contractor has measurable performance goals. Health 1. Strengthen the National Health Service Corps to put more physicians in the neediest areas, and make its scholarship funds tax-free. 2. Double the research budget of the National Institutes of Health. 3. Signed Medicare Reform, which includes: A 10-year privatization option. Prescription drug benefits: Prior to this reform, Medicare paid for extended hospital stays for ulcer surgery, for example, at a cost of about $28,000 per patient. Yet Medicare would not pay for the drugs that eliminate the cause of most ulcers, drugs that cost about $500 a year. Now, drug coverage under Medicare will allow seniors to replace more expensive surgeries and hospitalizations with less expensive prescription medicine. More health care choices: As President Bush stated, "…when seniors have the ability to make choices, health care plans within Medicare will have to compete for their business by offering higher quality service [at lower cost]. For the seniors of America, more choices and more control will mean better health care. These are the kinds of health care options we give to the members of Congress and federal employees. What's good for members of Congress is also good for seniors. New Health Savings Accounts: Effective January 1, 2004, Americans can set aside up to $4,500 every year, tax free, to save for medical expenses. Depending on your tax bracket, that means you'll save between 10 to 35 percent on any costs covered by money in your account. Every year, the money not spent would stay in the account and gain interest tax-free, just like an IRA. These accounts will be good for small business owners, and employees. More businesses can focus on covering workers for major medical problems, such as hospitalization for an injury or illness. At the same time, employees and their families will use these accounts to cover doctors visits, or lab tests, or other smaller costs. Some employers will contribute to employee health accounts. This will help more American families get the health care they need at the price they can afford. Homeland Security, Border Enforcement & Immigration 1. *See Government Reform above. Under President Bush's leadership, America has made an unprecedented commitment to homeland security. 2. Has CONSTRUCTION in process on the first 10 ABM silos in Alaska so that America will have a defense against North Korean nukes. Has ordered national and theater ballistic missile defenses to be deployed by 2004. 3. Announced a 9.7% increase in government-wide homeland security funding in his FY 2005 budget, nearly tripling the FY 2001 levels (excluding the Department of Defense and Project BioShield). 4. Before DHS was created, there were inspectors from three different agencies of the Federal Government and Border Patrol officers protecting our borders. Through DHS, U.S. Customs and Border Protection (CBP) now consolidates all border activities into a single agency to create "one face at the border." This not only better secures the borders of the United States, but it also eliminates many of the inefficiencies that occurred under the old system. With over 18,000 CBP inspectors and 11,000 Border Patrol agents, CBP has 29,000 uniformed officers on our borders. 5. The Border Patrol is continuing installation of monitoring devices along the borders to detect illegal activity. 6. Launched Operation Tarmac to investigate businesses and workers in the secure areas of domestic airports and ensure immigration law compliance. Since 9/11, DHS has audited 3,640 businesses, examined 259,037 employee records, arrested 1,030 unauthorized workers, and participated in the criminal indictment of 774 individuals. 7. Since September 11, 2001, the Coast Guard has conducted more than 124,000 port security patrols, 13,000 air patrols, boarded more than 92,000 vessels, interdicted over 14,000 individuals attempting to enter the United States illegally, and created and maintained more than 90 Maritime Security Zones. 8. Announced the Student and Exchange Visitor Information System (SEVIS), an internet-based system that is improving America's ability to track and monitor foreign students and exchange visitors. Over 870,000 students are registered in SEVIS. Of 285 completed field investigations, 71 aliens were arrested. 9. This week, the US-VISIT program began to digitally collect biometric identifiers to record the entry and exit of aliens who travel into the U.S on a visa. Together with the standard information, this new program will confirm compliance with visa and immigration policies. 10. Eliminated INS bureaucratic redundancies and lack of accountability. 11. Split the Immigration and Naturalization Service into two agencies: one to protect the border and interior, the other to deal with naturalization. 12. Signed the workplace verification bill to prevent hiring of illegal aliens. 13. Established a six-month deadline for processing immigration applications. 14. Information regarding nearly 100% of all containerized cargo is carefully screened by DHS before it arrives in the United States. Higher risk shipments are physically inspected for terrorist weapons and contraband prior to being released from the port of entry. Advanced technologies are being deployed to identify warning signs of chemical, biological, or radiological attacks. Since September 11, 2001, hundreds of thousands of first responders across America have been trained to recognize and respond to the effects of a WMD attack. Judiciary & Tort Reform 1. Is urging federal liability reform to eliminate frivolous lawsuits. 2. Killed the liberal ABA's unconstitutional role in vetting federal judges. The Senate is supposed to advise and consent, not the ABA. 3. Is nominating strong, conservative judges to the judiciary. 4. Supports class action reform bill which limits lawyer fees so that more settlement money goes to victims. Politics 1. His leadership resulted in Republican gains in the House and Senate, solidifying Republican control of both houses of Congress and the presidency. 2. Signed an EO enforcing the Supreme Court's Beck decision regarding union dues being used for political campaigns against individual's wishes. Second Amendment 1. Ordered Attorney General Ashcroft to formally notify the Supreme Court that the OFFICIAL U.S. government position on the 2nd Amendment is that it supports INDIVIDUAL rights to own firearms, and is NOT a Leftist-imagined "collective" right. 2. Signed TWO bills into law that arm our pilots with handguns in the cockpit. 3. Currently pushing for full immunity from lawsuits for our national gun manufacturers. 4. *See Globalization & Internationalism. Traditional Values, Compassion & Volunteerism 1. Endorses and promotes "The Responsibility Era." President Bush often speaks of the necessity of personal responsibility and civic volunteerism. He said, "In a compassionate society, people respect one another and take responsibility for the decisions they make in life. My hope is to change the culture from one that has said, if it feels good, do it; if you've got a problem, blame somebody else — to one in which every single American understands that he or she is responsible for the decisions that you make; you're responsible for loving your children with all your heart and all your soul; you're responsible for being involved with the quality of the education of your children; you're responsible for making sure the community in which you live is safe; you're responsible for loving your neighbor, just like you would like to be loved yourself." 2. Started the USA Freedom Corps, the most comprehensive clearinghouse of volunteer opportunities ever offered. For the first time in history, Americans can enter geographic information about where they want to get involved, such as state or zip code, as well as areas of interest ranging from education to the environment, and they can access volunteer opportunities offered by more than 50,000 organizations across the country and around the world. 3. Established the The White House Office and the Centers for the Faith-Based and Community Initiative — located in seven Federal agencies. The faith-based initiative supports the essential work of these important organizations. The goal is to make sure that grassroots leaders can compete on an equal footing for federal dollars, receive greater private support, and face fewer bureaucratic barriers. Work focuses on at-risk youth, ex-offenders, the homeless and hungry, substance abusers, those with HIV/AIDS, and welfare-to-work families. 4. The White House released a guidebook fully describing the Administration's belief that faith-based groups have a Constitutionally-protected right to maintain their religious identity through hiring — even when Federal funds are involved. 5. Issued an EO implementing the Supreme Court's Olmstead ruling, which requires moving disabled people from institutions to community-based facilities when possible. 6. Increased funding for low-interest loan programs to help people with disabilities purchase devices to assist them. 7. Revised the Department of Housing and Urban Development's Section 8 rent subsidies to disabled people, permitting them to use up to a year's worth of vouchers to finance down payments on homes. HUD has started pilot programs in 11 states. 8. Committed US funds to purchase medicine for millions of men, women and children now suffering with AIDS in Africa. 9. Heeding the words of our own Declaration of Independence, the president laid out the non-negotiable demands of human dignity for all people everywhere. On January 29, 2002, he said, "No nation owns these aspirations, and no nation is exempt from them. We have no intention of imposing our culture. But America will always stand firm for the non-negotiable demands of human dignity." As stated by the President, they are a virtual manifesto of conservative principles: Equal Justice Freedom of Speech Limited Government Power Private Property Rights Religious Tolerance Respect for Women Rule of Law
Dr, Clifford Colwell, Jr., MD is elicting funds for ProEnglish.org. Why? I recently received a solicitation in the mail from Dr. Clifford Colwell, Jr., MD who appears to have a legitimate and successful practice in California. Dr. Colwell is on the Board of Directors for ProEnglish.org. He and 5,000 + other doctors are suing to overturn an Executive Order passed by former President Bill Clinton mandating that doctors provide translation services for all patients or face stiff fines and possibly imprisonment. Dr. Colwell needs $30,000 to finance round two of this lawsuit and asks for donations of $500 to $250 from us. My calculations tell me if these 5,000 + doctors chip in $6 (six dollars) each they will have the money they need. If they chip in $100 each they can hire the best legal and investigative team in the country. I’m all for the push making America’s official language English, however, I have to question this solicitation by doctors who make 5 times the average salary of the average person. His letter is specific about raising $30,000 in legal fees for round two in the U.S. District Court. Any ideas on this man, organization and their cause? PJ. Thankjs for the answer. I was more interested in knowing if anyone has info on theis doctor, the organization he represents, and his mailings solicting donations for legal fees. Again, the request is to pay legal fees in the amount of $30,000 and if there are so many doctors involved in the law suit why would they not pay $6 each? The mailings do not indicate the money is for the English speaking organization.

What is this? I received some papers in the mail saying I was involved in a classaction lawsuit. It is called Fischer v. Finance America, saying I am included in a suit that is going to get a settlement loan. Is that legitimate? If so, what is a settlement loan?
