Litigation Finance Knowledge Base
How do I get a business attorney job after graduation? I graduated from Rutgers Law this year. I was a night student, worked as a litigation paralegal for two years at a 225 attorney firm, have good grades, was on the main journal, published an article in the journal. I was a finance major in undergrad and concentrated on business law classes at law school. All I want is a position as a business attorney at a large or mid sized firm. Unfortunatley, every where I apply they tell me that they are impressed with my credentials but they primarily recruit their summer associates for entry level jobs. I already sent out 100 cover letters and resumes! Can anyone give me any tips or share their experiences? Does any one know of any firms that are looking to hire? I took NJ and PA bar exam a few weeks ago. I would be willing to take a job anywhere and would take the bar in that locality. I've been applying to firms in Philly, NJ and NY.
Can a buyer file for a lis pendens on our home if they default and we litigate for their deposit? Our buyers turned down their mortgage because it was not to their liking. They missed the deadline of 30 days stated in the financing contingency that required them to notify us in writing that they did not obtain the mortgage. They are now threatening after 60 days and an offer from us to extend a Time being of the essence Letter to sue us for the deposit. If this does occur can this stop us from selling our home while in the litigation process?
Have financial advisers the best job in the world? Being a finance officer myself I do believe that the financial adviser is another term for salesman. They only tell you what they have on offer but never tell you (i.e. advise) which is the best option for your particular circumstances - in case of later litigation. So they are selling rather than advising. Financial Adviser sounds grand , better than a mere salesman
Am I the only stay at home mom with this problem? I am a stay at home mommy not only by choice but stay at home by default as well. I was in a terrible car accident 3 years ago that left me with nerve damage in my right arm and unable to work. I struggle with certain things and do house work at my own pace but ALWAYS, ALWAYS my home is spotless and little boy is healthy and happy. My husband works a good job, but financally we have been taken to our knees from my accident. (Still in litigation with the insurance company of the Tractor Trailer truck that hit me) I know that there is much stress in our marriage dealing with finances. Before the accident we always had. Now - we make it, but struggle. It just seems that my husband has no clue nor cares how hard I work making our house a home and raising our son. He comes home, does yard work occassionally and watches tv. Never really does anything to help, just tells me when 'the dryer went off'... or my son has a dirty diaper. He seems self-centered since my accident. Help?

Have you seen this????The news just keeps geting BETTER!!!? -------------------------------------------------------------------------------- INVASION USA Cities across nation crack down in illegals Frustrated by federal inaction, new measures spark growing movement -------------------------------------------------------------------------------- Posted: August 26, 2006 1:00 a.m. Eastern © 2006 WorldNetDaily.com Hazelton, Pa., Mayor Louis J. Barletta Frustrated by the federal government's immigration policy, small cities across the nation are taking enforcement into their own hands, passing laws that make it harder for illegals to live and work in their communities. Dozens of towns have followed the path of Hazelton, Pa., which passed an ordinance July 13 to deter housing owners from renting to illegals. Riverside, N.J., quickly passed a similar measure, which fines landlords $1,000 per day for renting to illegals and removes business licenses from employers who hire illegals. Already, legal action has been taken by opponents who insist the new laws usurp federal authority. The Puerto Rican Legal Defense and Education Fund, which is challenging Hazelton in court, says four communities have passed similar measures and another 17 are considering them, according to Stateline.org. On the state level, legislatures have considered a record 550 pieces of immigration-related legislation and passed at least 77 new laws in 27 states, Stateline.org said, citing the National Conference of State Legislatures. In Georgia, a massive immigration reform package passed in May sanctioned employers who hire illegals and anyone who offers them access to public services. Colorado's legislature later passed similar measures. In Pennsylvania, Hazelton Mayor Louis J. Barletta, an immigrant's grandson, says he wants to make his town "the toughest place on illegal immigrants in America." "What I'm doing here is protecting the legal taxpayer of any race," he told the Washington Post. "And I will get rid of the illegal people. It's this simple: They must leave." While the law doesn't take effect for another month, the Republican mayor already sees progress, according to the Post. "I see illegal immigrants picking up and leaving -- some Mexican restaurants say business is off 75 percent," Barletta said. "The message is out there." Elsewhere: In Valley Park. Mo., earlier this month, landlords began evicting residents who don't have legal status in the country. Landis, N.C., unanimously passed an ordinance that requires residents to conduct business with the town in English only, the local Kannapolis Independent Tribune reported. Alderman James Furr said the reason for the ordinance is to get everyone on the same page. "We want to welcome immigrants to Landis and want to understand them," Furr said. "When someone comes before the board, I want to know them." A nearby town, Mint Hill, N.C., is considering an ordinance that would go a step further, making English the official language but also punishing business owners that hire illegal workers or provide them services. Business owners would face loss of licenses for up to five years on the first offense, the Kannapolis Independent Tribune said. In Escondido, Calif., city leaders voted 3-2 last week to draft an ordinance to punish people who provide jobs and housing to illegal immigrants. Councilman Ed Gallo said the council's charge is to "provide for the health and safety of the residents of Escondido. Is it wrong then to ask them to be here legally?" Hispanics make up 42 percent of the town's 142,000 people. In Farmers Branch, Texas, a city councilman plans to propose similar measures and also wants to stop publication of any documents in Spanish and eliminate subsidies for illegal immigrants in the city's youth programs, according to KWTX-TV in Waco, Texas. In Riverside, N.J., the city council already has adjusted to court challenges, approving several amendments to reinforce an ordinance that bans hiring or housing illegal immigrants, the Philadelphia Inquirer reported. In Arcadia, Wisc., the new mayor, John Kimmel, is being accused of racism for plans to make English the official language and to create an "illegal alien task force" that would forward complaints to federal authorities and hold landlords accountable for renting to illegal immigrants, reported the Associated Press. The city council of Altoona, Pa., introduced an ordinance Wednesday calling for fines and revocation of licenses for employers who hire illegal aliens and landlords who house them. Officials there, however, will not include making English the official language because they fear it would not be legally defensible, the Altoona Mirror newspaper reported. Councilman Ron Reidell said the ordinance is justifiable because illegal aliens "breaking the law sap our resources, and they show themselves unwilling to go through channels others have navigated at great expense and effort." Meanwhile, some employers themselves are cracking down on the hiring of illegals. Companies in California are using the state's unfair competition statutes to sue competitors, claiming their rivals gain an unfair advantage by hiring illegals at lower wages, without pensions or workers compensation. Groups that oppose illegal immigration are helping finance the legal actions, the Associated Press reported, believing the tactic could prompt a wave of litigation across the country that would deter hiring of illegals. Statistics compiled by the U.S. Immigration and Customs Enforcement show immigration law enforcement at work sites is limited. Last year, just 1,145 work site arrests were recorded, compared to 2,849 in fiscal 1999. Federal borders agents in at least one sector also are taking initiative, cooperating with local governments to m make a 210-mile stretch along the Texas-Mexico border a "zero-tolerance zone" for illegals. Rather than being immediately sent home, illegals caught in this area – surrounding Del Rio, Texas – are arrested, prosecuted and sometimes sentenced to prison before being formally deported, the AP reported. Federal officials, in fact, have praised the effort as a creative combination of local and federal resources to curb illegal entry. Other border sectors have not engaged in such a practice because of limited resources. In the Del Rio sector, however, authorities have found bed space elsewhere in the region and assigned federal agents to help prosecute cases, the AP said. "There's nothing we're doing that wasn't already on the books," said Hilario Leal Jr., a supervisory Border Patrol agent in the Del Rio sector. "It's nothing new. We just started enforcing the law." I think "mizgreeneyez" needs a lesson in economics!!

Real estate S.O.S Re: Sales Contract? Hello, I recently put in a offer on a home in which the seller accepted. (This home is near an airport). Anyhow, I heard the airport is going to expand, so I went down to City Hall to speak with the Planning & Development Commission. I spoke to the manager there, and he did confirm the property that I am interested is in the airport plans of being purchased. As far as time frame the person couldnt guarantee me when this will take effect presumably shooting for 10-20 years. Upon learning this information, I told my realtor that I would like to rescind the contract based upon the information I learned. She indicated there are only 3 ways to rescind, which are 1. house doesnt appraise. 2. Buyer doesnt get financed. 3. If the inspection doesn't pass. She told me that the owners hold the power to reject the contract, and if they dont that means I could end up in Litigation. Is this true? And are there any other laws in the State of Arkansas that protect the buyer?

The example that he cited are based on relationships, yes- whether they be a cousin or a hairdresser. However, the GREAT BIG DIFFERENCE is that when someone goes out of their way to verbally expound the degree of influence that someone has on you as well as when you tout this person as a role model or "mentor" - well now this is VERY dofferent. By doing this, you indeed are connecting yourself to this person in every way since you indicated that their beliefs were used to mentor and foster your own beliefs. When you look up to someone as a mentor or role model, you are believing in the basic principles of theirs. Obama's open statements to th ereverend being his spiritual mentor and best friend makes his beliefs as suspect as the reverend's. In addition, Obama can now denounce all he wants to but how could he be a parishioner for 17 years and listen to these types of statements if as Obama NOW states are "outrageous"? I think that we need to realy questiob Obama's truthfullness or question his judgement. In either case, the country should seriously reconsider any support for such a candidate. It is frightening that Obama's paltform really emphasizes "change" and his real agenda would seem to indicate other. We need to change our support to Senator Clinton and assure her success in November.3/17/2008 9:05:12 PMRecommend (0) Report Abuse Discussion Policy LISANROY wrote:amemended comments of dr kamal roy dt 3,17,2008LISANROY wrote:COMmENTS OF REV DR KAMAL KARNA Karuna ROY A REPUBLICAN CANIDATE AND HoPEFUL TO BE the NOMINEE OF GOP IN SCHEDULED ELECTION FOr NOV 4, 2008, IF BE HELD WITHOUT any COURT ORDER OF INJUNCTION to postpone corrpt election as PRAYED BY DR kamal k k ROY ALLEGING SKY_HIGH AND CLOUD_DARK CORRUPTIONS BY DEFENDANTS IN CIVIL ACTIONS FILED IN 20+ U S D COURT actions in 20+ different JURISDICTIONS with allegations against defendants for negligence to enforce laws not TO PUSH OUT ELECTORAL CONTESTANTS FROM WEAKER COMMUNITIES OF HAVE-nots 3/17/2008 9:04:05 PMRecommend (0) Report Abuse Discussion Policy rmorris391 wrote:well this is "midly amusing". It is a thinly veiled attempt to incite debate over issues, and non-issues, which may be unrelated to the national campaign. While the Mainstream Media (MSM) has too much time on its hands, to consider a long winded campaign, the focus has shifted to non-political discourse, about intractable problems that confound american society. We have issues related to baseball players, after all, who alledgedly used illegal substances to puff up their biceps. Certainly, congress can devise a surge campaign to intervene with major league baseball, and save the poor players from the rich players. After all, the economic crisis in MLB is looming, and requires some "foreign ownership equity." This is, afterall the land of "ownership." At least that is what a young president Bush promised the american public. The Wright story was not out when he was getting votes from whites due to his "unity" message. It falls flat now. As I said before, I think he loses that Wright issue any way you slice it. Roy has filed lawsuits against God, U.S. Presidents, Supreme Court Justices, fast food restaurants, foreign leaders.[2], and Wikipedia [3] [4].Roy's lawsuits have addressed, among many other things, actions taken by President George W. Bush, overcharging by telecommunication companies, the appointment of Chief Justice John Roberts to the Supreme Court, and "failure of democratic societies and God's role therein."[5] In 2006 Judge Michael W. McConnell of The United States Court of Appeals for the Tenth Circuit described a typical Roy complaint:Roy, a/k/a Joseph Geronimo, Jr. filed a 115-page complaint, a 144-page amended complaint, and a 40-page second amended complaint against over sixty defendants, including among many others President Bush, God as U.S.-based divine benefactor, several government agencies, The New York Times, and Kentucky Fried Chicken. In addition to pages of rambling discourse, the complaint contains numerous illegible handwritten remarks.[6]The Tenth Circuit went on to affirm the district court's dismissal of the complaint holding that no discernible claim was apparent from the complaint. Judge McConnell also humorously noted that the court "strongly suspect[ed] at least one defendant was not properly served."[7]Most, if not all, of Roy's complaints have been dismissed. A 2006 United States District Court for the District of Delaware opinion, Jungle Democracy v. U.S., describes Roy as "no stranger to litigation" and provides a partial list of Roy lawsuits that have been dismissed since 1991.[8]Despite Roy's lack of success in the courts, his lawsuits have been discussed in law school classrooms and in law related blogs.[9] [10]In April 2007 Roy filed a civil rights action against, among others, CBS Broadcasting Inc., MSNBC, the United States Government, and controversial radio shock jock Don Imus.[11]In October, 2007, Roy filed a suit in the US District Court, Middle District of Florida, against "Wikipedia Encyclopedia, USA, All News Media, All State Board of Elections, Federal Election Commission". How to make collections stop calling? Ok here's the deal. I have a very small private student loan. It's through Iowa Student Loan Liquidity Corp. I filed for a forbearance on it last summer because I was about to give birth to my first child and finances were tight. Well, apparently, the loan wasn't eligible for a forbearance. But, ISLC never called me (or my mom, who is a cosigner) and they never sent me anything by mail at all. I just found out that the loan is in default - never received any notification of that either. Don't they legally have to notify me? They said they did, but obviously not. So, I have been making payments to the collection agency that's collecting on the debt. But this stupid guy keeps calling me and harrassing me! He's even told me that if I didn't pay the whole thing he'd have my wages garnished or litigation. I've been paying them so shouldn't they STOP calling me? What should I do?
Is this your dear sweet union supporting Hillary? In 1986, when Hillary was first lady of Arkansas, she was put on the board of Wal-Mart. Officials at the time said she wasn't filling a vacancy. In May 1992, as Hubby's presidential campaign heated up, she resigned from the board of Wal-Mart. Company officials said at the time that they weren't going to fill her vacancy. So what the hell was she doing on the Wal-Mart board? According to press accounts at the time, she was a show horse at the company's annual meetings when founder Sam Walton bused in cheering throngs to celebrate his non-union empire, which is headquartered in Arkansas, one of the country's poorest states. According to published reports, she was placed in charge of the company's "green" program to protect the environment. But nobody got greener than Sam Walton and his family. For several years in the '80s, he was judged the richest man in America by Forbes magazine; his fortune zoomed into the billions until he split it up among relatives. It's no surprise that Hillary is a strong supporter of free trade with China. Wal-Mart, despite its "Buy American" advertising campaign, is the single largest U.S. importer, and half of its imports come from China. Was Hillary the voice of conscience on the board for American and foreign workers? Contemporary accounts make no mention of that. They do describe her as a "corporate litigator" in those days, and they mention, speaking of environmental matters, that she also served on the board of Lafarge, a company that, according to a press account, once burned hazardous fuels to run its cement plants. Wal-Mart, though, was the crown jewel of Arkansas, the state's First Company fit for a first lady. During her tenure on the board, she presumably helped preside over the most remarkable growth of any company until Bill Gates came along. The number of Wal-Mart employees grew during the '80s from 21,600 to 279,000, while sales soared from $1.2 billion to $25.8 billion. And the Clintons depended on Wal-Mart's largesse not only for Hillary's regular payments as a board member but for travel expenses on Wal-Mart planes and for heavy campaign contributions to Bill's campaigns there and nationally. According to reports in the early '90s, before Bill and Hillary moved to D.C., neither was raking in the big bucks, but prominent in their income were her holdings of between $50,000 and $100,000 worth of Wal-Mart stock. A press report on the Clintons' finances during the early stages of Bill's 1992 run for the presidency showed that most of their income came from her $109,719 annual salary from the Rose Law Firm and tens of thousands of dollars in fees she received from serving on corporate boards. (She was on two others besides Wal-Mart's.) Her honoraria and director fees grew almost as fast as Wal-Mart's profits during the '80s—rising from $111 in 1980 to $6500 in 1986 to $64,700 in 1991, according to the same source. During the same period, small towns all over America began complaining that Wal-Mart was squeezing out ma-and-pa stores and leaving little burgs throughout the Midwest and South with downtowns that featured little more than empty storefronts. But selected small companies were doing quite well, thanks to the Clintons' friendship with Wal-Mart. The Boston Globe reported in January 1992 that Bill Clinton had introduced a brush company's executives to Wal-Mart executives, hoping that the two could do bidness. Executives of the brush company had been rebuffed in previous attempts to sell their products to Wal-Mart. Lucky for the company, it happened to be located in New Hampshire, where Clinton was trying to win a presidential primary. At the time, Hillary Clinton was still on Wal-Mart's board, and the retail giant was still resisting the unionization of any of its workers. Last week, Hillary was wearing a different hat. She stood in solidarity with the elderly Teamsters as Local 237 president Carl Haynes greeted her warmly, endorsed her, and then left early on what other union officials described as "AFL-CIO business." But the AFL-CIO was thinking of other business only a few months earlier when the union's leaders, including its chief, John Sweeney, marched specifically against Wal-Mart's oppression of its meat-market workers. According to a Web site run by activists at the AFL-CIO affiliate United Food and Commercial Workers, Wal-Mart "has profited by pushing its workers to the bottom of the wage scale." The union points out that hourly wages "average $2 to $3 per hour less than at unionized supermarkets." More grave for workers everywhere in the United States are these figures spouted by union activists: Wal-Mart is the largest private employer in the country, "yet fewer than 40 percent of its workers are covered by the company's health plan." The union notes that Wal-Mart's "hometown" judge in Arkansas issued a nationwide temporary restraining order against the UFCW, barring anyone associated with the union from entering Wal-Mart facilities to educate workers about their legal rights in the workplace. The union, however, successfully appealed the order—noting that the judge holds more than $500,000 in Wal-Mart stock. The case remains in litigation. Meanwhile, Wal-Mart's first lady, who also benefited from Wal-Mart stock, solicits support from union workers. Which makes her words to the elderly Teamsters last week especially poignant: "You can count on me to stand up for the right to collectively bargain!" Right on, sister! http://www.villagevoice.com/news/0021,harkavy,15052,5.html Laura, you are right but, question .... a conspiracy committed by who?
How do most enployees react when called to HR to recieve notification of court ordered wage garnishment? I was chagrined and extremely embarrassed to recieve a copy of the order from our payroll manager as I rely on my wife to handle our finances, and had no idea we had fallen so far behind in our credit card debt. I know we were sent notification of both pending litigation and of the actual court date, but my wife either blew them off or did not realize the signifigance of them, and never informed me. So I know it is possible for an employee to not know in advance.
